The Personal Data Protection Law No. 6698 was adopted on March 24, 2016, and published in the Official Gazette dated April 7, 2016, No. 29677. This law aims to protect individuals’ fundamental rights and freedoms, particularly the right to privacy, during the processing of personal data, and to regulate the obligations of real and legal persons who process such data. This Clarification Text has been prepared under Law No. 6698 and other relevant legislation to inform you about the purposes, legal grounds, and your rights regarding the processing of your personal data.

About the Data Controller

As FADİ GRUP Yatırım ve Hukuk, we will process your personal data in accordance with the relevant legislation as the data controller within the scope of Law No. 6698.

Purposes of Personal Data Processing

Collected personal data and, if applicable, sensitive personal data are processed under the conditions and purposes specified in Articles 5 and 6 of the Law. These include emergency planning, employment procedures, legal obligations, HR policies, payroll, insurance, visitor and staff entry-exit tracking, internal auditing, communication, logistics, sales support, marketing, legal tracking, and other business continuity activities.

Collection Method and Legal Grounds

Your personal data may be collected verbally, in writing, or electronically via automatic or non-automatic means through departments of FADİ GRUP, websites, social media platforms, training/seminars, and similar means in line with the purposes described above.

Personal Data May Be Processed Without Consent If:

- Explicitly provided for by law
- Required to protect life or physical integrity where consent cannot be obtained
- Directly related to forming or executing a contract
- Required to fulfill legal obligations
- Already made public by the data subject
- Required for the establishment, use, or protection of a right
- Necessary for the legitimate interest of the data controller, provided it does not harm fundamental rights

Sensitive Personal Data

As per Article 6, personal data relating to race, religion, health, and other special categories cannot be processed without explicit consent, except as allowed by law.

Data Sharing and Transfers

Your personal data may be shared with authorized institutions, domestic/foreign affiliates, shareholders, business partners, and service providers in accordance with the law and limited to the specified purposes.

Retention and Destruction

Personal data will be stored as long as necessary for the purpose it was collected or as required by law. Once this necessity ceases or upon request, the data will be deleted, destroyed, or anonymized using appropriate methods.

Your Rights Under Article 11

You have the right to:
- Learn whether your personal data is processed
- Request information about it
- Learn the purpose and its appropriate use
- Know the third parties to whom data is transferred
- Request correction or deletion
- Object to outcomes against you based on automated processing
- Request compensation for damages due to illegal use
